Luckily it is just the nut spacer ordered a couple of them and some new cotter pins, going to drain and inspect the lower unit oil this weekend keeping fingers crossed it's not milky or no metal shavings.

Not looking good I couldn't even get the lower drain plug out, it stripped even with using the biggest flat head I could find

Sorry to hear that. If this is an Evinrude/Johnson/OMC-BRP engine the world's greatest lower unit guy lives in Charleston, TN. Eddie Pope. Sign on the BassBoatCentral.com forum and look up "Gearcaseman". Carry it down there and get it fixed right.
